In addition, CABLEEN may cease to provide (permanently or temporarily) the Service (or any item of these Terms and Conditions) to the User and/or users with or without notice. 
The most recent update to these Terms and Conditions of Use will be made available for your review and compliance at all times and will supersede all previous versions. 

CABLEEN reserves the right, in its sole discretion, to deny access to any person who has violated any provision of these Terms and Conditions. Your rights under these Terms and Conditions of Use will terminate if you fail to comply with any of the agreed Terms and Conditions set forth below and you will be expressly notified of termination of the Service. These Terms and Conditions of Use are effective until terminated. 

All content and materials on this Service, including but not limited to the display, presentation and distribution of text, images, files, graphics, photographs, and/or messages, illustrations and information (collectively "Content") are protected by copyrights and other intellectual property rights owned, controlled, registered and/or acquired from CABLEEN. Some of the names, logos, or other images incorporated by CABLEEN in this Service are also protected as registered or unregistered trademarks, trade names and/or service marks owned by CABLEEN ("Trademarks") before the Mexican Institute of Industrial Property. The use of the Contents and the Trademarks may not be different from that mentioned in the Service. 

References to CABLEEN in these Terms and Conditions of Use includes its directors, officers, employees, shareholders, subsidiaries, affiliates, partners, agents, licensors, Service providers, distributors and/or anyone else who has been involved in the creation, production and distribution of the Service or any Content therein. 

 

SERVICE ENTRY. 

Each time you access the Service, you represent and warrant to CABLEEN that you are aware of the following criteria: (1) you have, know and accept these Terms and Conditions; (2) you have the capacity to enter and understand these Terms and Conditions; (3) you are the owner of the copyright of the images, texts and/or other elements that you wish to incorporate in your cover, or that you have the respective authorizations of the owner to exploit and commercialize them, and that you are aware of the risks and sanctions that this may imply in case of non-compliance. 

Please note that in order to access the Service, your computer or other devices must be connected to the Internet and must be properly activated to receive messages and/or any other Content from the Service. You are entirely responsible for the costs and maintenance of any necessary Internet connection. 

In addition, it is your sole responsibility to ensure that you have logged on to the appropriate platform required to join the Service. Please check the requirements periodically, since CABLEEN reserves the right to modify or discontinue support for any hardware and software platform at any time. 

USE OF THE SERVICE. 

1. CREATION OF YOUR VIRTUAL ACCOUNT

In order to place any order, you must create your own virtual account within the Service. In order to do so, you must click on the "register" button located at the top of the page, upon entering you will be asked to provide the following registration details: First Name, Last Name, email, password, country and to confirm the password provided. In order to safeguard the confidentiality of your password CABLEEN recommends using "strong" passwords (passwords that use a combination of upper and lower case letters, numbers and symbols). 

In order to finalize the process of creating your Registered Account, you must read and understand these Terms and Conditions, as well as the  Privacy Noticeregarding the use of your personal data, by accepting in the corresponding box. In case you require a monthly newsletter to be sent to you, you can provide your email address and you will be part of our list of clients who will receive privileged and interesting information that may be useful to you. 

Once you have done this, a page will appear asking you to verify your account through your email address. To do so, you must enter the designated email address, and enter the email address you have provided. CABLEEN will send you. Once you have done this, you must click on "confirm my account". 

It is a condition of use of these Services that the data provided is correct, up to date and complete and does not violate any law. Yes CABLEEN believes that any data is incorrect, out of date or incomplete, or has otherwise violated these Terms and Conditions or any law, it has the right to suspend or terminate your Registered Account or deny you access to the Service. 

You may not choose a user name that contains words, expressions or graphic names that have already been previously chosen by another user of the Service, or otherwise, that are unpronounceable, offensive, that coincide with trademarks, trade names, signs or names of establishments, company names or corporate names, advertising expressions, names or aliases of publicly relevant persons, or famous or registered by third parties, whose use is not authorized and, in general, against the law or the requirements of generally accepted and properly appropriate ethical practices. 

You are responsible for all activities that occur under your Registered Account, including the confidentiality of your User Name and Password. CABLEEN shall not be liable for any loss or damage caused by the use or misuse of your Registered Account or failure to comply with the registration requirements. 

In order to facilitate the payment process and sending of invoices, CABLEEN will ask you to provide the corresponding data for sending your invoice, as well as the information related to the form of payment you wish to make the payments you generate. In this section you will be asked for (i) e-mail address, (ii) name of the bank and (iii) CLABE interbank. 

It is worth mentioning that these data are not mandatory at the moment of registration, and that CABLEEN This is done so as not to disturb the user when he/she has to make a payment. If you wish to continue without filling out this information, you may do so. 

RESTRICTIONS ON THE USE OF CONTENT. 

Content and other materials displayed on this Service may be used for personal, entertainment, recreational, commercial and/or similar purposes. 

You may not copy, reproduce, duplicate, upload, transmit, distribute, transfer, display, exhibit, sell, license, publish, database, modify, create derivative works from, edit, publish, link, credit, rent, lease, loan or sublicense or in any way exploit any part of this Service or the contents, or attempt to interfere with the operation and/or performance of the Service in any way. You may not use the Service to: (a) provoke, threaten, insult, disparage, invade the privacy of or harm other members registered on the site; (b) attempt to illegally access the database of CABLEEN and/or third parties; (c) alter and/or copy files or promote them, obtain passwords and data from third parties without their prior authorization, and/or violate the Industrial Property Law, the Federal Copyright Law or any applicable regulation including without limitation the rights to reputation, intimacy, personal and family privacy. Finally, you agree to comply with the ethical and moral standards in force on the Internet and with the corresponding national and international laws. 

You also may not use the Service to disseminate content that: (a) violate the law, ethical standards, good practices, intellectual and industrial property, rights to reputation, privacy, personal and family privacy; (b) encourage unlawful conduct, or contrary to ethical standards and good practices; (c) provoke the performance of harmful acts, whether based on sex, race, religion, beliefs, age or any other condition; (d) make available or allow access to messages containing products or services that are illegal, violent, pornographic or degrading; (e) incite or may incite to an unacceptable state of anxiety or fear; (f) induce or incite to dangerous, risky, harmful and mentally unbalancing and harmful practices; (g) that are false, ambiguous, uncertain, exaggerated or extemporaneous, so as to be misleading as to their object or as to the intention or purposes of consumers; (h) violate the privacy rights of third parties; (i) in any way, either directly or indirectly, establish or attempt to induce an establishment to create a situation of unfair competition and/or (j) provoke or encourage child abuse. 

You will not acknowledge any portion of the Service or the use of any data mining, robots or similar data gathering and extraction tools on the Service or any part of the Service. 

You may market or otherwise dispose of the products you purchase from the Service in any manner you choose, and you do so at your own expense, without further business and commercial relationship with CABLEEN. 

In the event that you carry out commercial activities of resale on the products, or any other activity, you will not have any relationship with CABLEENThe activities are subsequent to the relationship that existed when you acquired the products of the service or received payments for the sale of products containing the designs made by you. 

You may not assign, sublicense, pledge or transfer any of your rights or obligations under these Terms and Conditions to any person or company (and any proposed assignment, pledge, sublicense or transfer without prior written consent is void). These files may not be used to develop or construct databases of any kind. 

In addition to the prohibition against modifying the content, use of such materials on any other site or computer network, or use of the materials for any purpose other than personal use, is a violation of copyright, trademark and other proprietary rights and, accordingly, a violation of these Terms and Conditions. Also prohibited are: decompiling, reverse engineering, disassembling, or otherwise reducing the code used in any program or digital rights management function of the Service into a format. 

SERVICE UPDATES. 

At various times, HINT INTERIORS may choose to make available updates, bug fixes or other changes or enhancements to the Service (collectively, "Service Updates"). Service Updates may be: (a) automatic, such as in connection with general changes to the Service and additional features or updates to data required by the Service; (b) at your election, you will receive at a time of your choosing information and instructions on how to accept optional Service Updates; and (c) mandatory, where your consent to Service Updates or to install or update various features that are required by the Service will be required. CABLEEN deemed necessary. 

Occasionally, CABLEEN may test the Service and reserves the right to include its Services in these tests without prior notice. 

PUBLICATIONS. 

Any images, e-mails, notes, messages, postings, or other materials that contribute to the Service shall at all times remain the property of the user who mentions them. In this regard, you acknowledge and agree that CABLEEN or any of its officers, employees or subsidiaries shall not be held liable in the event that these publications affect the industrial and intellectual property rights of third parties. 

DISCLAIMER OF LIABILITY AND WARRANTIES ON THE SYSTEM. 

Use of this Service is at your own risk. This Service and all Content are provided "as is" and "as available" to users without warranty of any kind, either express or implied. CABLEEN does not warrant that the Content, the functions contained in the material, information, applications, software, servers, tools, Service functions or other content will be uninterrupted or error-free, (b) that any defects that may arise will be corrected, (c) that CABLEEN or the servers that make the Content available and free of viruses or other harmful components, or (d) the results of the use of the Content, information, software, equipment, functions or other content on this Service or any site linked to the Service in terms of its correctness, accuracy, reliability or otherwise. 

CABLEEN does not issue any type of warranty: 

That the website or its contents will meet the User's needs; 

That the website or service will be continuous, timely, secure or error-free; 

That the images on the customizer, as well as all other images on the website, are accurate. 

That the quality of the products, services, information or other material purchased or obtained by the User through our website will meet the User's expectations; 

That existing defects will be corrected; 

Regarding unauthorized access to or use of our servers, insurance and/or personal and/or financial information stored therein; 

As to any bugs, viruses or similar that may be transmitted by or through our services or by any third party;

The User agrees that CABLEEN shall have no liability for any damages suffered by the User in connection with the website or any content on the site. The User expressly agrees that the risk of using this website, including all content, data or software distributed by the website or downloaded or accessed there from or through the website, shall be borne entirely by the User. The User understands and agrees that he/she assumes all liability for any damage caused. 

PRODUCT WARRANTY DISCLAIMER 

CABLEEN is not responsible for the use that the user gives to the product, since they are products that may suffer scratches, breakage or damage of any kind. 

SHIPPING 

The user accepts that the processing time of any order is 1-3 business days, which start counting from the next business day in which your payment is successfully processed. Consequently, the user accepts that the package delivery times are independent of the order processing time. 

CABLEEN is not responsible for the shipping times that the courier companies handle, as well as claims, delays, loss, misplacement, theft or damage caused to the products requested by the user. 

COMMENTS AND PUBLICATIONS. 

You may be asked to provide us with feedback on Content or other parts of the Service. Please note that CABLEEN does not accept unsolicited content proposals, creative ideas, suggestions, stories, or other possible content, provided by anyone. This is to avoid possible misunderstandings in the future. Therefore, please do not send any unsolicited communications. In any case, any material you send will not be treated as confidential. 

Also, please note that your comments will not be acknowledged and will not create a confidential, fiduciary or special relationship between you and CABLEEN. You acknowledge and agree that CABLEEN does not have and will not have in the future, any duty or liability (direct or indirect) with respect to the infringement or protection of copyrights with its images, content and comments and that CABLEEN is not responsible for the loss, cancellation, failure to store or misdelivery of any comments or information submitted. 

In this act, you represent and warrant that you have the necessary rights to each and every one of the images or content that you provide to the System, and that they do not infringe any property right, whether industrial, intellectual or of any third party. 

INVESTIGATIONS/VIOLATIONS. 

CABLEEN reserves the right to investigate suspected violations of these Terms and Conditions, and may seek to gather information from the user suspected of violating these Terms and Conditions, and from any user who is suspected of having violated these Terms and Conditions. It may also suspend the use of any user whose conduct is subject to investigation and may remove Content from its server as inappropriate without prior notice. Yes CABLEEN believes, in its sole discretion, that a violation of these Terms and Conditions has occurred, it may warn users, suspend Users and Passwords, terminate Registered Accounts or take such other corrective action as it deems appropriate. 

CABLEEN you may provide personally identifiable information in response to legal process, for example, in response to a court order or subpoena. BY AGREEING TO THESE TERMS AND CONDITIONS YOU HEREBY WAIVE AND RELEASE CABLEEN OF ANY CLAIM THAT MAY BE APPLICABLE, AS WELL AS OF ANY ACTION THAT MAY BE TAKEN BY IT OR BY ACTING IN COMPLIANCE WITH JUDICIAL OR ADMINISTRATIVE ORDERS. 

CARD PAYMENTS. 

At any time CABLEEN may request official documents proving that you are the holder of a credit and/or debit card, if they are not presented. CABLEEN will reimburse the amount and it will appear on your card statement within 15 business days from the day the reimbursement was authorized. 

COPYRIGHT POLICY. 

CABLEEN respects the intellectual property of others and expects users of the Service to do the same. In this regard, CABLEEN respond to notifications of alleged copyright infringement that are made in accordance with applicable Mexican law. 
If you believe or believe that your Content has been copied in a way that constitutes an infringement of your or any third party's copyright, CABLEEN strongly requests that the following information be provided: (I) physical or electronic signature of the copyright owner or the person authorized to act on his behalf; (II) documents evidencing ownership of the copyright alleged to have been infringed; (III) identification data of the images or content alleged to have been infringed to enable CABLEEN (IV) the user's information, including the virtual store and other data that may exist. In this sense, CABLEEN reserves the right, at any time, to prosecute any violation of industrial property rights, intellectual property including copyright or other intellectual property laws to the fullest extent of the law, including civil and criminal penalties. 

Thus, it should be emphasized that CABLEEN reserves the right to remove allegedly infringing content without prior notice and at its sole discretion. Under certain circumstances, CABLEEN may also close your account if you are a repeat offender. 

DIVISIBILITY. 

If any provision of these Terms and Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be severed from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. This is the entire Terms and Conditions agreed between the parties relating to the matters contained herein.
